SECTION 01016
SAFETY DURING CONSTRUCTION
PART 1 - GENERAL
1.01 SCOPE OF THIS SECTION:
This Section provides specific information and defines general and specific requirements of the Contractor regarding safety during construction. This section also sets forth governmental regulations and industry standards which are included and incorporated herein by reference and made a part of the specification. This section sets forth those notices and permits which are known to the Owner and which either must be applied for and received, or which must be given to governmental agencies before start of work .
1. Requirements include adherence to work practices and procedures set forth in applicable codes, regulations and standards.
2. Requirements include obtaining permits, licenses, inspections, releases and similar documentation, as well as payments, statements and similar requirements associated with codes, regulations and standards.
1.02 RESPONSIBILITY FOR SAFETY:
The Contractor shall assume full responsibility and liability for compliance with all applicable Federal, State, and local laws or regulations pertaining to work practices, hauling and disposal of hazardous materials, and protection of workers, visitors to the site, and persons occupying areas adjacent to the site. The Contractor is responsible for providing medical examinations and maintaining medical records of personnel as required by the applicable Federal, State, and local regulations. This requirement shall apply continuously and not be limited to normal working hours.
1.03 CONSTRUCTION SAFETY PROGRAM
A. The provisions of the program shall conform to the Federal and State Departments of Labor Occupational Safety and Health Act (OSHA), and all other applicable Federal, State, county, and local laws, ordinances, and/or codes. Where any of these are in conflict, the more stringent requirement shall be followed. The Contractor’s failure to thoroughly familiarize himself with the aforementioned safety provisions shall not relieve him from compliance with the obligations or relieve him of the penalties set forth therein.
B. The Contractor shall appoint from the duration of this Contract a qualified supervisory employee to develop and/or supervise the Contractor’s job safety program.
C. The Contractor shall submit to the Engineer, within ten (10) working days after the start of construction, two (2) copies of the job safety program adopted and to be enforced by the Contractor during the performance of the work.
D. Neither the Owner nor the Engineer shall be responsible for safety precautions and programs in connection with the work.
1.04 ACCIDENT REPORTS
A. If death or serious injuries damages are caused, the accident shall be reported immediately by telephone or messenger to the Owner and Engineer. In addition, the Contractor must promptly report in writing to the Engineer all accidents in connection with the work, giving full details, names, and statements of witnesses.
B. If a claim is made by anyone against the Contractor or any subcontractor on account of any accident, the Contractor shall promptly report the facts in writing to the Owner and Engineer, giving full details of the claim.
1.05 SAFETY EQUIPMENT:
A. The Contractor shall maintain, at the jobsite, safety equipment applicable to the work as prescribed by the governing safety authorities and all articles necessary for giving first aid to the injured and shall establish the procedure for the immediate removal to a hospital or a doctor’s care of persons who may be injured on the jobsite.
B. The performance of all work and all completed construction, particularly with respect to ladders, platforms, structure openings, scaffolding, shoring, lagging, and machinery guards, shall be in accordance with the requirements of applicable governing safety authorities.
1.06 SPECIAL SAFETY PRECAUTIONS ASSOCIATED WITH THE WORK:
A. General: The Contractor is alerted that the existing facilities have been in operation for many years. Existing coatings may contain lead. The Owner will cause the existing coatings to be tested for lead prior to issuance of the task order. If the task order indicates the presence of lead, the Contractor will follow all applicable requirements of Contract pertaining to lead abatement. In such cases, any workmen involved in the removal, handling and/or disposal of equipment materials, or waste products associated with the work shall be protected from exposure to lead particles. It is the Contractor’s responsibility to require his personnel (including subcontractors) to observe hygienic precautions, including making available any inoculations, as applicable. The Contractor shall provide the Engineer a written certification that all personnel and visitors of the Contractor and Contractor’s subcontractors and supplies have been made aware of this article of the Specifications.
B. Worker Protection Program: The Contractor shall provide for review prior to the start of work a worker protection program which specifies procedures to reduce risk of lead exposure to on-site employees and authorized visitors. In all instances, refer to the OSHA Interim Final Rule on Lead in Construction, 29 CFR 1926.62 for comprehensive requirements. The elements of a worker protection program will include as a minimum:
1. Engineering and Work Practice Controls
2. Respiratory Protection Program
3. Protective clothing and equipment
4. Medical surveillance and provisions for medical removal
5. Exposure monitoring
6. Record Keeping
7. Training
1.07 FIRE PREVENTION AND PROTECTION:
The Contractor shall execute all work in a fire-safe manner. He shall supply and maintain on the site adequate fire-fighting equipment capable of extinguishing incipient fires. The Contractor shall comply with applicable federal, state and local fire-prevention regulations. Where these regulations do not apply, applicable parts of the National Fire Prevention Standard for Safeguarding Building Construction Operations, (NFPA No. 241) shall be followed.
1.08 TRAFFIC SAFETY AND ACCESS TO PROPERTY:
Comply with all rules and regulations of city, state and county authorities regarding closing, use of, or restricting the use of public street or highways. No public or private road shall be closed, except by express permission of the Metropolitan Government of Nashville and Davidson County, Department of Water Services. Conduct the work so as to assure the least possible obstruction to traffic both within and outside of the construction site. Protect all obstructions within traveled roadways by installing approved signs, barricades, and lights where necessary for the safety of the public and workers.
1.09 CODES AND REGULATIONS:
General Applicability of Codes and Regulations and Standards: Except to the extent that more explicit or more stringent requirements are written directly into the Contract Documents, all applicable codes, regulations, and standards have the same force and effect (and are made a part of the Contract Documents by reference) as if copied directly into the Contract Documents, or as if published copies are bound herewith.
1. OSHA: U.S. Department of Labor, Occupational Safety and Health Administration, (OSHA), including but limited to:
(a) Respiratory Protection - Title 29, Part 1910, Section 134 of the Code of Federal Regulations.
(b) Lead Standard - Title 29, Part 1926.62, of the Code of Federal Regulation.
(c) Cadmium Standard - Title 29, Part 1926.63 of the Code of Federal Regulations.
(d) Access to Employee Exposure and Medical Records - Title 29, Part 1910, Section 20 of the Code of Federal Regulations.
(e) Hazard Communication - Title 29, Part 1926.59, Section 1200 of the Code of Federal Regulations.
(f) Specification for Accident Prevention Signs and Tags - Title 29, Part 1910, Section 145 of the Code of Federal Regulations.
2. DOT: U. S. Department of Transportation, including but not limited to: Hazardous Substances, Title 29, Part 171 and 172 of the Code of Federal Regulations.
3. EPA: U. S. Environmental Protection Agency (EPA), including but not limited to: Resource Conservation and Recovery Act (RCRA), Title 40, Part 261 - Part 265 of the Code of Federal Regulations.
4. State Requirements: Including, but not limited to: Tennessee Solid Waste Processing and Disposal Regulations, Rule Chapters 1200-1-7-.01 through 1200-1-7-.08.
5. Local Requirements: Abide by all local requirements which govern hazardous work or hauling and disposal of hazardous waste materials.
1.10 STANDARDS:
A. General Applicability of Standards: Except to the extent that more explicit or more stringent requirements are written directly into the Contract Documents, all applicable standards have the same force and effect and are made a part of the Contract Documents by reference as if copied directly into the Contract Documents, or as if published copies are bound herewith.

1.11 STATE AND LOCAL AGENCIES
Send written notification as required by state and local regulations, if applicable, prior to beginning any work on lead-containing materials.
1.12 PERMITS:
A. Permit: All hazardous and special waste is to be transported by an entity maintaining a current “Industrial Waste Hauler Permit” specifically for transporting hazardous waste materials to a disposal site.
B. Licenses: Maintain current licenses as required by applicable state or local jurisdictions for the removal, transporting, disposal or other regulated activity relative to the work of this Contract.
1.13 POSTING AND FILING OF REGULATIONS:
Posting and Filing of Regulations: Post all notices required by applicable federal, state, and local regulations. Maintain one copy of applicable federal, state and local regulations and standards at job site and one copy on file in Contractor’s office.
